Q: I read your article about tennis courts being converted to pickleball courts requiring a 75 percent vote. That did not happen at my homeowners’ association (HOA). What is the law on this please? R.D., Naples

A: The community association law column that you refer to states in pertinent part, “unless your condominium documents provide for another method for the approval of material alterations, 75 percent of the total voting interests is needed.” This is pursuant to Section 718.113(2)(a) of the Florida Condominium Act, which states the following:

Except as otherwise provided in this section, there shall be no material alteration or substantial additions to the common elements or to real property which is association property, except in a manner provided in the declaration as originally recorded or as amended under the procedures provided therein. If the declaration as originally recorded or as amended under the procedures provided therein does not specify the procedure for approval of material alterations or substantial additions, 75 percent of the total voting interests of the association must approve the alterations or additions before the material alterations or substantial additions are commenced. This paragraph is intended to clarify existing law and applies to associations existing on July 1, 2018.

In my opinion, converting a tennis court into a pickleball court constitutes a material alteration of the common elements.

Plans are advancing for a members-only beach club in North Naples.

Since Collier commissioners unanimously approved the plans in October, the club has attracted investors and signed up more than 150 members.

Construction is expected to start soon on the multimillion-dollar project, known as Paraiso Beach Club.

“We actually are close to being ready to break ground. We anticipate that will be somewhere in the first quarter of 2026, then we are looking at a 15- to 18-month build time,” said David Tingley, a local businessman and seasoned executive in the financial services industry, who is the driving force behind the project.

If all goes as planned, he said, construction should be completed by the third quarter of 2027 — allowing for a “soft opening” late in the year, inside of the busy season.

Meanwhile, the membership drive is underway, and it’s going better than expected, attracting 160 members already, Tingley said.

Collier commissioners unanimously approve new 3,200-home rural village

With a unanimous vote, Collier commissioners approved a new rural village.

At a meeting Dec. 9, the board greenlighted the new village, known as Horse Trials.

The development is planned on nearly 1,218 acres on the north side of Oil Well Road, west of State Road 29. It’s the eighth village or town the county has approved in the environmentally sensitive Rural Lands Stewardship Area (RLSA).

The stewardship area, adopted nearly 20 years ago, encompasses 185,000 acres around Immokalee, east of Golden Gate Estates, with the Florida Panther National Wildlife Refuge to the south and the Okaloacoochee Slough State Forest to the north.

The voluntary RLSA program allows developers to build higher-density towns and villages on property with lower conservation value in exchange for preserving the most environmentally sensitive land through a credit system.
